Thank you for visiting YouFit.com (the “Website), which is owned and operated by YF FC Operations, LLC (“YouFit”, “we”, “us” or “our”)). You may come into any club to join without using the Website. We provide this Privacy Policy on our Website to explain how YouFit may collect, use, and share information about you through its Website or mobile application, and other electronic and digital means of communication that we control and that contain a link to this Privacy Policy (collectively called here Website”) and through offline channels including but not limited to our POS systems, telephone calls, in-person interactions, social media or use of our facilities (collectively called “Services”). This Policy is incorporated into and subject to the Terms of Use that can be also found on YouFit.com.
By accessing or using the Website and Services, or otherwise submitting personal information to us, you indicate your understanding that the collection, use, and sharing of your information is subject to the terms of this Privacy Policy, and our Terms of Use. If you do not consent to the collection, use, and sharing of your personal information as described, please do not use the Website or Services or otherwise provide us with such information. You may opt out of data collection in various ways by following the opt-out methods described in this Privacy Policy below. Unless disclosed otherwise, our affiliated websites are governed by this Privacy Policy. Third Party links in our website are governed by their own Privacy Policies and we recommend you read those policies before using a Third Party link from our Website.
Use of the Website is intended for residents of and visitors to the states where a YouFit Gyms is located, Florida, Georgia, Louisiana, Maryland, Rhode Island and Virginia. These are the states where YouFit does business.
We reserve the right to change this Privacy Policy from time to time in our sole discretion. If we make material changes to this Privacy Policy, we will provide notice of such changes, by providing notice through the Website or updating the “Effective Date” date at the beginning of this Privacy Policy. We encourage you to review this Privacy Policy and check the Effective Date to learn about material changes since your last visit to the Website whenever you use or access the Website or otherwise interact with us to stay informed about our information practices and the ways you can help protect your privacy.
WHAT INFORMATION DOES YOUFIT COLLECT FROM ME?
YouFit gathers information from you at various points in your interactions with us. The amount and type of information we gather depends upon your use of the Website, what devices you use and, in some cases, what type of information you choose to disclose. We may collect the following information from you:
PERSONAL INFORMATION PROVIDED BY YOU
We collect information from you when you voluntarily register with YouFit and/or submit your personal information to us over the Website or social media such as TikTok, Snapchat, Meta or Facebook messenger, Google or other browers. Such personal information may include your name, email and postal addresses, phone number, gender, age, health and fitness information, product and/or membership plans purchased, any account number assigned to you by YouFit, any customer identification number assigned to you by our payment processor, and other information which you voluntarily provide to us.
This Privacy Policy specifically applies to information collected from you over the Website; however, there are a number of circumstances off the Website and “in real life” where you may provide personal information to us as well, including but not limited to:
We may also collect biometric information in using certain equipment at the clubs or upon entrance. If you use certain of our mobile applications, we may collect information about any fitness devices that you choose to connect to the application, such as sensors and wearable devices, as well as the activity and other information collected through any such fitness devices. In addition, if you choose to add a third-party fitness data platform to the mobile application (such as Apple Health, Google Fit, or Fitbit), we may collect information from any such platform. Such information may include, for example, body measurements and activity types and data (e.g., steps, heart rate, distance, speed, sleep). You may revoke your consent to such sharing by accessing the settings for the relevant platform.
YouFit makes no effort to segregate information collected on the Website from that provided by you off-Website or in real life. Accordingly, personal information collected on the Website could be combined with information collected through other avenues.
INFORMATION YOU MAKE PUBLIC
The Website and other interactions with YouFit may allow you to upload, post, transmit, display, perform or distribute content, including personal information about yourself. For example, you may choose to include personal information within a public-facing review or testimonial, which is available and accessible to all visitors of the media. Any information that you choose to disclose by means of such features becomes public information over which YouFit is unable to exercise control. You should take caution when deciding to disclose personal information by means of such features.

When you use the Website, we automatically gather information made available by your web browser (such as Microsoft Edge or Google Chrome), Internet service provider (such as Comcast or Cox), and device (such as your computer, phone, or tablet), depending on your settings for each. YouFit may receive information about you and your Internet activities if you have provided it to a Third Party and we subsequently acquire the information from the Third Party. Such information may include, but is not limited to, your personal and online interests and Internet browsing habits. These Third Parties may have collected such information by placing Cookies on your device, using web beacons, gathering IP addresses and log data, and so forth. The purpose of this practice, which is sometimes called “retargeting,” is to deliver content and membership plans on the Website, you may later see YouFit memberships advertised to you on Facebook.
The Website may contain embedded content (e.g., videos) from Third Parties. Embedded content may place third-party cookies on your device that track your online activity to enhance your experience or assess the success of their application. We have no direct control over the information these cookies collect, and you should refer to the Third-Party Website privacy policy for additional information.
Opinions, advice, statements, or other information made available through the Website by third parties are those of their respective authors and should not necessarily be relied upon. Those authors are solely responsible for their content. YouFit does not: (i) guarantee the accuracy, completeness, or usefulness of any third-party information accessible on or through the Website; or (ii) adopt, endorse, or accept responsibility for the accuracy or reliability of any opinion, advice, or statement made by a third party through the Website. Under no circumstances will YouFit be responsible for any loss or damage resulting from your reliance on information or other content posted through the Website transmitted to or by any third party.
PAYMENT INFORMATION
All payments initiated through the Website are processed by third-party vendors, including ABC Financial, Shopify, and Authorize.net, and not YouFit itself. If you make a purchase on the Website, credit card numbers, ACH information, and related information, such as billing address, card number, and the expiration date of the card (“Credit Card Information”) is collected from you, and such information may be sent directly from you to our payment processors through embeddable widgets.
CHATBOT
By submission of your questions to the chatbot, you have consented to use of the chatbot under this Privacy Policy. You are not required to use the chatbot. The chatbot is solely intended for your convenience and is not intended to provide advice on your fitness journey. By submitting questions to the chatbot, you have agreed that your inputs may be recorded and stored for YouFit usage in monitoring and improving our systems, website, and services. Your questions may be used to further train and improve our staff and/or AI system. Once that information has been input, it cannot be deleted from the system. Please do not submit personal information through the chatbot that you do not want recorded. Please be aware that the responses and output to your submissions may have been generated by an AI system solely off information contained on this website, in conjunction with the questions you have submitted. The responses and output are provided as-is without any warranties or representations of accuracy and should be used only as a potential reference point for further research. You should not rely on this information for personal health information but instead consult with relevant experts or authorities.
HOW WE USE INFORMATION WE COLLECT FROM YOU
TO MARKET TO YOU
Your email address. At YouFit, we respect your privacy concerns. If you give us your email address when you inquire about membership, request a free trial guest pass, reserve a new gym opening membership rate, enter a sweepstakes, or sign up for our content and newsletters, we will send you emails about exclusive offers, news at YouFit and new club openings. If you have previously opted out of receiving emails from us, providing updated information will act as an ‘opt back-in.’ We also use pixel tracking on the emails we send. We use the information collected from these pixels for marketing purposes to learn more about our audience. For example, these pixels help us determine information including how many people open our emails, click on links, the percentage of recipients who read email on their phones, etc. If you want to opt-out of receiving promotional emails, simply click on the unsubscribe link located at the bottom of our emails. Although we strive to update our email list as frequently as possible, you might receive another contact before we can remove you. Please note that you will continue to receive Member Services-related communications regarding your member account. YouFit may use any of your contact information held on file (including email, mailing address, and phone number) to communicate for transactional purposes related to daily administrative activities such as freeze requests, online purchases, and important service alerts.
Your phone number. If you provide your mobile telephone number and opt-in to receiving promotional text messages, we may use it for our text messaging program. Please note that by signing up for text message communications, you expressly consent to the collection, use, and sharing of your mobile phone number and personal information as outlined in this Policy and as permitted or required by applicable law. With your consent, this includes sharing your mobile phone number with the specific affiliate(s) and related entities you have opted into for their marketing purposes. We may also share your mobile phone number with our service providers or subcontractors who support the services we provide. Your mobile phone number will not be shared with third parties or affiliates for their marketing or promotional purposes without explicit consent. You can opt out of our sharing your mobile phone number with our affiliates and related entities by contacting us at [email protected]. Please note that members cannot opt out of our sharing your number with our service providers or subcontractors for the purposes of providing services such as payment processing.
TO ADVERTISE
Advertising. We or third parties may use or disclose the information of members, former members, or prospective members to deliver emails, social media posts, etc. to you for our advertising partners, to enable other third parties to market to you, or to create advertising campaigns. This may include enriching information we collect about you with information from third parties.
Third Parties. From time to time, YouFit may make the services of third-party providers available to members and or members’ guests to enhance their YouFit experience. To do so, YouFit will provide the third-party provider with member or member’s guest data to enable the delivery of these services. YouFit does not warrant the quality of these services and does not guarantee that these services will remain available to members or member’s guests for any period of time.
COOKIES AND OTHER TECHNOLOGIES ON THE WEBSITE
We use technology that provides information about you in several ways and from time to time, may add additional technology or change a technology we use. “Cookies” are files that are placed on your device by Websites you visit. The purpose of a Cookie is to identify you as a unique user of the Website. A web beacon is programming code that can be used to, among other things, transfer an individual’s unique user identification (often in the form of a Cookie) to a database and associate the individual with previously acquired information about an individual in a database. This allows us to track certain Websites you visit online. Web beacons are used to determine products or services you may be interested in, and to track online behavioral habits for marketing purposes. We may also use “pixel tags,” which are small graphic files that allow us to monitor the use of our websites and can collect information about you. The Website uses Facebook meta pixels. By providing your email address, telephone number, or mobile number to YouFit through the Website, you consent to receive calls, emails, and texts from YouFit, including information concerning your membership, special offers from YouFit, and advertising and telemarketing messages. Calls and messages may be sent to you through an automatic telephone dialing system or an artificial or prerecorded voice. Providing such consent is NOT a condition of membership or a condition of purchasing any property, goods, or services from YouFit. You can unsubscribe from promotional phone calls and text messages by following the instructions therein. You can unsubscribe to marketing or survey emails at any time by clicking the unsubscribe link within the email. Please note that, even if you unsubscribe from marketing or survey emails, we will still send you any necessary, non-promotional emails about your account, updates to our privacy policy and terms or to respond to any customer service inquiries or requests.
To Improve our clubs or services
YouFit uses the information we collect from you and other users to improve our Clubs and Services. For example, we may consider analytics, demographics, and user feedback collected via the Website in determining whether there is sufficient demand for a new Club or service.
To improve the Website
YouFit uses the information we collect from you and other users to provide and improve the Website. As explained above, we use Cookies and pixel tags, including those placed by Third Parties, to gather statistical information that helps us understand how you and other users engage with the Website and improve its performance. The analytics services may transfer this information to third parties in case of a legal obligation or if a third-party processes data on behalf of that service. We use Google Analytics 4, which is a cross-platform analytics tool. This tool uses data anonymization by default.
To Interact with Social Media
The Website may include social media features including but not limited to Facebook, Instagram, TikTok, Linked In, YouTube, Google, and X “share” buttons. If you use these features, they may collect your IP address and the pages you visit on our website and set a cookie to enable the feature to function properly. These services will also authenticate your identity and provide you the option to share certain personal information with us, such as your name and email address, to pre-populate our sign-up form or provide feedback. Your interactions with these features are governed by the Privacy Policy of the third-party company providing them.
HOW DOES YOUFIT SHARE MY INFORMATION?
To Fulfill Your Orders
We may transfer your information to Third Parties when necessary to provide a product or service that you order from us. For example, as explained above, your credit card information is provided directly to our payment processor through the Website so that you can be charged (and we can be paid) for your online purchase.

We may also share your information with third party service providers or advertising partners to use for their marketing purposes, in accordance with applicable law, if we think the products or services, they offer would be of interest to you. We partner with companies that assist us in advertising our Services, including partners that use cookies and online tracking technologies to collect information to personalize, retarget, and measure the effectiveness of advertising. We may share your personal information with our third-party market partners. For example, we may share your email address with our email fulfillment provider.
To Social Media Platforms. If you interact with us on social media platforms, the platform may be able to collect information about you and your interaction with us. If you interact with social media objects on our websites (for example, by clicking on a Facebook “like” button), both the platform and your connections on the platform may be able to view that activity. To Our Affiliated Companies
We may disclose, transfer, and sell your information to our affiliated entities—that is, businesses that have common ownership with us—at our discretion, in which event, your information shall be treated by the affiliated entities in accordance with this Privacy Policy.
To Other businesses in the context of a commercial transaction: We may change our ownership or corporate organization while providing the Services. We may transfer to another entity or its affiliates or service providers some or all information about you in connection with, or during negotiations of, any merger, acquisition, sale of assets or any line of business, change in ownership control, or financing transaction. We cannot promise that an acquiring party or the merged entity will have the same privacy practices or treat your information as described in this policy. Should YouFit be subject to an acquisition, merger, sale or other change of control or business entity status or sell a business line or club location assets, we reserve the right to transfer or assign your information as part of that acquisition, merger or sale.
HOW AND WHERE DOES YOUFIT SECURE MY INFORMATION?
YouFit, and the Third-Party vendors we use to store your information, employ security measures (such as SSL encryption and HTTPS protocol) to protect against the loss, misuse, and alteration of the information under our control. For payment processing, we use PCI compliant payment processing and card holder data solutions protected by secure cryptographic protocols and algorithms and hashes. However, no system can be completely secure. Therefore, although we take steps to secure your information, we cannot promise, and you should not expect, that your personal and commercial information, or other communications, will always remain secure. YouFit stores personal information in the United States. If you are visiting Youfit.com from a location outside of the United States, your connection will be through and to servers located in the United States, and all information you provide will be processed and securely maintained in our web servers and internal systems located within the United States. By using Youfit.com you authorize and specifically consent to the transfer of personal information to the United States and its storage and use as specified above when you provide such information to us.
We seek to use physical, technical and administrative security measures designed to protect your personally identifiable information. However, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please immediately notify us.
You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.
HOW DOES YOUFIT PROTECT THE PRIVACY OF CHILDREN?
Please do not use our website if you are under the age of 13. YouFit will never knowingly collect any personal information about children under the age of 13. If we obtain actual knowledge that we have collected personal information about a child under the age of 13, that information will be immediately deleted from our database. Because we do not collect such information, we have no such information to use or to disclose to Third Parties. We have designed this policy in order to comply with the Children’s Online Privacy Protection Act (COPPA).

HOW DO I MAKE CHOICES ABOUT MY SHARING OR DELETING MY PERSONAL INFORMATION?

Retention of your Personal Information (“PI”). We retain your PI for as long as necessary, such as to provide you products and Services or while you have an open membership with us. We may retain your PI for longer if it is necessary to comply with our legal or reporting obligations, resolve disputes, collect fees, etc. or as permitted or required by applicable law. We may also retain your PI in a deidentified (not reasonably associated with your PI) or aggregated form so that it can no longer be associated with you or share it with Third Parties in an aggregated form. To determine the appropriate retention period for your PI, we consider various factors such as the amount, nature, and sensitivity of your information; the potential risk of unauthorized access, use or disclosure; the purposes for which we process your PI; and applicable legal requirements.
Access. YouFit respects your control over your information, and, upon request, we will confirm whether we hold or are processing PI that we have collected from you. You also have the right to amend or update inaccurate or incomplete PI, request deletion of your PI, or request that we no longer use it. Under certain circumstances, we may not be able to fulfill your request such as when it interferes with our regulatory obligations, affects legal matters, we cannot verify your identity, or it involves disproportionate cost or effort. Still, in any event, we will endeavor to respond to your request within forty five (45) days and provide you with an explanation if we are not able to comply with your request.
Please note that for PI we have obtained about you or received for processing on behalf of a separate, unaffiliated entity – which determined the means and purposes of processing – all such requests should be made directly to that entity. We will honor and support any instructions they provide us concerning your PI.

e-Marketing Communications. If you want to opt-out of receiving promotional emails, simply click on the unsubscribe link located at the bottom of our emails. To unsubscribe from any e-marketing communications we send you, follow the instructions in the communication or contact us at [email protected].

APPLICABLE LAW
This Policy is governed by the internal substantive laws of Florida, without regard to its conflict of laws principles. Jurisdiction for any claims arising under or out of this Policy shall lie exclusively with the state and federal courts within Florida. If any provision of this Policy is found to be invalid by a court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Policy, which shall remain in full force and effect.
